1. Acceptance of Terms
Welcome to Uhmegle ("Platform", "we", "our", or "us"). By accessing, browsing, or utilizing the Uhmegle website, services, applications, and any related software provided by us, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all the terms and conditions outlined in this agreement, you must immediately cease all usage of our platform.
These Terms constitute a legally binding contract between you, the user ("User", "you", or "your"), and Uhmegle. We reserve the right to modify, update, or entirely replace these Terms at our sole discretion at any time. All modifications become effective immediately upon being published on this page. Your continued use of the platform following the posting of updated Terms constitutes your explicit acceptance of those changes.
2. Eligibility and Age Requirements
Uhmegle is firmly committed to maintaining a safe environment. To utilize our services, you must meet the following age requirements:
- You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is greater, to use this service independently.
- If you are between the ages of thirteen (13) and eighteen (18), you may only use this service with the explicit permission, active involvement, and direct supervision of a parent or legal guardian who fully agrees to be bound by these Terms on your behalf.
- If you are under the age of thirteen (13), you are strictly prohibited from using Uhmegle under any circumstances.
By clicking "Start Chatting" or accessing our service, you affirmatively represent and warrant that you meet these eligibility requirements. We reserve the right to block or restrict access if we reasonably suspect that a user is violating these age restrictions.
3. Description of Service
Uhmegle provides a random, anonymous communication platform facilitating real-time text and video chatting between users worldwide. The platform utilizes advanced WebRTC (Web Real-Time Communication) technology to establish peer-to-peer (P2P) connections. This means that audio and video data are transmitted directly between your device and the connected stranger's device, without being permanently stored on our central servers.
We provide the infrastructure to match users based on randomly generated algorithms or explicitly shared interests (via the "Interests" tag feature). However, we do not control, endorse, or guarantee the nature of the conversations or the individuals you will be matched with. You acknowledge that you use the service entirely at your own risk.
4. User Conduct and Prohibited Activities
To ensure that Uhmegle remains a safe and welcoming community, you agree to adhere strictly to the following rules of conduct. While using the platform, you shall NOT:
- Transmit Illegal Content: Share, display, or promote any material that violates local, national, or international laws, including but not limited to child sexual abuse material (CSAM), non-consensual intimate imagery, or terrorism-related content. We report CSAM to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement immediately.
- Harass or Threaten: Engage in cyberbullying, stalking, intimidation, or the display of targeted hatred against any individual or group based on race, religion, gender, sexual orientation, disability, or national origin.
- Display Nudity or Sexual Content: Unless in designated, explicitly marked sections (if any are provided and age-gated), the display of genitalia, sexual acts, or pornographic material on the general public cameras is strictly forbidden.
- Spam and Commercial Activity: Utilize the platform to advertise products, broadcast commercial links, or solicit users for financial gain, crypto-currency schemes, or external subscriptions.
- Use Automated Bots: Deploy scripts, scrapers, spiders, or automated bots to interact with the service, collect user data, or artificially inflate chat queues.
- Share Personal Information: Maliciously "dox" others by revealing their private information, or recklessly share your own sensitive information (such as your full legal name, home address, social security number, or financial details).
Violations of these User Conduct rules will result in immediate termination of your access to the service, including permanent IP bans and device-level fingerprint blocking.
5. Moderation, Privacy, and Enforcement
Uhmegle employs a combination of artificial intelligence screening tools and human moderation to monitor the platform for violations of these Terms. While we strive to maintain a clean environment, you acknowledge that due to the real-time, peer-to-peer nature of the service, you may inadvertently be exposed to content that is offensive, indecent, or objectionable.
By using the platform, you grant us the right (but not the obligation) to monitor text chat logs and, where flagged by users or our automated systems, review video screenshots to enforce these Terms. Our data handling practices, including how we process IP addresses and moderation data, are comprehensively outlined in our Privacy Policy, which is incorporated into these Terms by reference.
6. Intellectual Property Rights
All content, features, and functionality on the platform—including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and the underlying software architecture—are the exclusive property of Uhmegle or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the platform strictly in accordance with these Terms. You may not copy, modify, create derivative works of, publicly display, or reverse-engineer any portion of the Uhmegle platform without our prior written consent.
7. Disclaimer of Warranties
YOUR USE OF UHMEGLE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. UHMEGLE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Uhmegle makes no warranty that (i) the service will meet your requirements or expectations, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, or (iv) the conduct or content of any third-party user will be safe or free from offensive material.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UHMEGLE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the service;
- Any conduct, content, or communication of any third party on the service, including without limitation, any defamatory, offensive, or illegal conduct of other users;
- Unauthorized access, use, or alteration of your transmissions or content.
In no event shall our aggregate liability for all claims relating to the service exceed the greater of one hundred U.S. dollars ($100.00 USD) or the amount you paid us, if any, in the last 12 months.
9. Indemnification
You agree to defend, indemnify, and hold harmless Uhmegle and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your device and IP address; b) a breach of these Terms; or c) your violation of any third-party right, including without limitation any right of privacy or intellectual property rights.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Delaware, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. You agree to waive any right to a jury trial or to participate in a class-action lawsuit.
11. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
